If you're sorting through a parent's or loved one's estate and wondering how to sell their Valencia home, you're not alone, and you don't have to figure out probate on your own. Selling an inherited home in Valencia usually means selling the property as-is, working through some version of probate authority, and getting every heir on the same page before the home goes on the market. Jon and I have walked Santa Clarita families through this exact process, and the short version is this: it's manageable, it just moves on its own timeline. Here's what actually happens, step by step.

Key Takeaways
  • Most inherited homes in Valencia sell as-is, with no repairs required before listing.
  • Whether the sale needs a court hearing depends on the personal representative's authority, full or limited.
  • Heirs generally need to agree on price and terms before the home goes under contract.
  • Typical timelines run 45 to 75 days with full authority, longer if the sale needs court confirmation.

Do we have to sell a Valencia inherited home as-is?

In almost every case, yes, and that's usually a relief once you hear it out loud. Selling as-is is the norm for inherited property, not the exception. Heirs are often managing the estate from out of town, the home may reflect decades of the original owner's updates (or lack of them), and buyers who make offers on probate and trust sales generally expect to take the property in its current condition. Valencia is a useful example of why this matters. It's Santa Clarita's master-planned hub, with tree-lined streets and a wide mix of housing ages, from original 1970s and 1980s tracts to newer construction built in the 2000s and beyond, including the FivePoint area near the Westfield Valencia Town Center. A probate sale here might involve a long-time owner's original home with original finishes, or a home built more recently. Either way, Jon and I price and market it for what it is. Nobody expects a fresh remodel from an estate sale.

What authority does the personal representative actually have to sell the home?

This is the first thing your probate attorney will tell you, and it changes everything else about how the sale runs. If the personal representative, the executor or administrator named for the estate, has full authority under California's Independent Administration of Estates Act (IAEA), they can list the home, negotiate offers, and accept a buyer much like a normal sale. Once an offer is accepted, a Notice of Proposed Action goes out to all the heirs and beneficiaries, who then have 15 days to object in writing. If nobody objects, the sale closes without ever setting foot in a courtroom. With full IAEA authority, a typical timeline runs about 45 to 75 days from accepted offer to close.

What if the estate doesn't have full authority to sell?

Then the sale needs court confirmation, and that adds real time and a few extra steps. A probate referee appraises the property, and any accepted offer has to be at least 90% of that appraised value. The estate attorney files a Report of Sale petition, the court sets a confirmation hearing, and at that hearing other interested buyers can overbid the accepted offer. The court confirms the sale to the highest bidder. This version typically takes 90 to 150 days or more. One local detail worth knowing: probate court for every Santa Clarita Valley city, including Valencia, Saugus, Newhall, Castaic, Canyon Country, and Stevenson Ranch, is centralized at one courthouse, the Stanley Mosk Courthouse in downtown Los Angeles. There's no separate probate court closer to home, so heirs should expect their court dates to happen downtown. We go deeper on the tax and court mechanics, including how overbids work and what step-up in basis means for what you'll owe, in our companion post on selling an inherited home: taxes and probate court. This section here is meant to be the short version, not the whole picture.

What if there's more than one heir on the Valencia home?

Then everyone generally needs to agree, whether that's each heir individually or the personal representative acting on the estate's behalf. This is one of the more common things that slows a probate sale down. Siblings don't always agree on price, timing, or whether to make any updates before listing. Our job is to give every heir the same market information at the same time, in plain language, so the decision is about the facts of the Valencia market rather than who trusts whose opinion. A calm, documented process tends to head off most of the friction before it starts.

What if I'm the heir and I don't live in Santa Clarita?

That's actually more common than not. A lot of the Valencia inherited homes Jon and I see involve an heir who lives somewhere else entirely, sometimes out of state. We coordinate the parts that require being local, cleaning out the property, meeting inspectors, letting in a stager or photographer, and we handle contracts, disclosures, and updates remotely so you're not flying in every other week. Selling a home you're not living near is stressful enough without also being the one running every showing.

How long does the whole process typically take?

It depends on the authority question above, but a few other details are worth knowing while you plan. A probate listing agreement in California is capped at 90 days at a time, renewable in 90-day increments up to 270 days total. That's rarely a problem in practice, most inherited homes in Valencia sell well within that window, but it's good to know the rule exists if the estate needs more time to settle other matters first. Between the authority question, any needed cleanout, and normal market time, most families should plan on a couple of months at minimum from the decision to sell to a closed transaction.

What about taxes on an inherited home sale?

Here's the version every heir should know going in, and then talk to a CPA about how it applies to your specific estate. When you inherit real property, the IRS resets the cost basis to the home's fair market value on the date the original owner passed away. That's called a step-up in basis, and it means capital gains are calculated only on appreciation after that date, not on decades of appreciation the original owner may have seen. Inherited property is also automatically treated as a long-term capital gain, regardless of how briefly the heir owns it before selling. This is genuinely good news for most families, but it's not personalized tax advice, and every estate has its own wrinkles. Talk to your CPA or the estate's probate attorney before you file anything.

Frequently Asked Questions

Do we have to sell an inherited home in Valencia as-is?

In almost every case, yes. As-is selling is the norm for inherited and probate homes, since heirs are often managing the estate from out of the area and buyers generally expect to take the property in its current condition.

Does every heir have to agree before we sell?

Generally yes. If there's more than one heir, all of them, or the appointed personal representative acting for the estate, typically need to agree on price and terms. Disagreement among heirs is one of the more common things that slows a probate sale down.

What is a Notice of Proposed Action, and why does it matter?

It's the notice a personal representative with full IAEA authority sends to all heirs and beneficiaries after accepting an offer. Heirs then have 15 days to object in writing. If nobody objects, the sale closes without a court hearing, which is what keeps the 45 to 75 day timeline realistic.

How does step-up in basis affect what we owe in taxes?

Step-up in basis resets the property's cost basis to its fair market value on the date of the original owner's death, so capital gains are calculated only on appreciation after that date. It's a meaningful tax benefit for most heirs, but talk to a CPA about how it applies to your specific estate.

Where does probate court happen for a Valencia or Santa Clarita estate?

All Los Angeles County probate matters, including Valencia and every other Santa Clarita Valley city, are heard at the Stanley Mosk Courthouse in downtown Los Angeles. There's no separate probate court closer to home, so plan for court dates downtown if the sale needs court confirmation.

How long does a probate listing agreement last?

California caps a probate listing agreement at 90 days at a time, renewable in 90-day increments up to 270 days total under Probate Code Section 10150(c). Most inherited homes in Valencia sell well within that window.
